Terms of Use of the Free Plan
ESKape Sportsbook Feed · version free-2.4-2026-10-23 · in force from 23 October 2026
1. Introduction
1.1 These Terms of Use (the Terms) form a binding agreement between Evgeni Stefanov Krastev, an individual practising a liberal profession (freelancer) under the laws of the Republic of Bulgaria, registered in the BULSTAT Register under UIC 180745014, VAT number BG180745014, with address for correspondence at 4 Galiley Street, 4018 Plovdiv, Bulgaria, and email management@eskape.pro, trading as ESKape (ESKape, the Provider, we, us), and the business, company or registered professional that registers for the Free Plan (you, the Subscriber). Once the incorporation of the Bulgarian single-member limited liability company (EOOD) is complete and the company is entered in the Commercial Register, ESKape's rights and obligations under these Terms may be transferred in full to that company under section 17.2, and we will notify you by email.
1.2 The Terms govern your access to and use of the ESKape Sportsbook Feed on the Free Plan: the API, the documentation at https://eskape.pro/feed and the API description at https://eskape.pro/openapi/public.json (the Documentation) and everything they return (together the Service). The real-time hub described in the Documentation is not part of the Free Plan.
1.3 You accept the Terms by ticking the acceptance box and submitting the registration form, or by using a Key. The registration records the version of the Terms you accepted, the time in UTC and the IP address from which it was made. If you do not agree, do not register and do not use a Key. Any person accepting on behalf of a legal entity, or as a sole trader or freelancer, confirms that they are authorised to bind the Subscriber.
1.4 The Terms, the list of competitions (Annex A), the Free Plan (Annex B), the Documentation and our privacy notice constitute the entire agreement between us regarding the Free Plan. As the Free Plan is entirely free of charge, paid plans and fees fall outside the scope of this agreement; they will be governed by separate commercial terms once the company has been incorporated.
1.5 Marketing campaign. Every new Subscriber receives free access to the Free Plan under ESKape's introductory marketing campaign, which supports the market launch of the Service, the testing of its stability and the collection of product feedback. The Free Plan runs for 90 days (three months) from the date of registration and expires automatically on the 90th day; in exceptional cases ESKape may extend it at its discretion under section 6.3. No payment is required on the Free Plan and no payment card details are collected. The registration records the date of registration and the date on which the Free Plan expires; both are available via GET /api/subscriptions/me (planEndsAtUtc).
2. Definitions
- Output means everything the Service returns to you: fixtures, probabilities, decimal odds, prices of same-game combinations and binary contracts, suspension flags, settlement results and other data, whether derived from our model or from Your Odds.
- Free Plan means the plan described in Annex B: free of charge and limited in duration, number of requests and competitions.
- Key means the API key issued to you on registration, and any replacement.
- Your Odds means the 1X2 and over/under odds you submit for a fixture under section 5.3.
- Licensed Operator means a Subscriber that holds a valid licence or registration to organise betting, or a platform that provides its system only to operators holding one, and has declared it under section 3.3.
- Licensed Territory means a territory in which a Licensed Operator holds a valid licence or registration to organise betting and for which it uses the Output.
- Your Customers means the players and other end users to whom a Licensed Operator offers bets or services, and any operator it serves as a platform.
3. Who may use the Free Plan and what it may be used for
3.1 Business customers only. The Service is offered and provided solely for the purposes of the Subscriber's independent business, commercial or professional activity (business to business). Access is permitted only to:
- licensed betting operators;
- business-to-business platforms that provide their systems to licensed operators;
- independent software developers, experts and IT specialists who evaluate, test and integrate software in the course of their professional activity.
The Service is not offered to consumers, to members of the public acting outside that professional sphere, or to persons who intend to use the Output to place bets of their own. As the agreement is concluded entirely between professionals for business purposes, the Subscriber confirms that it is not a consumer within the meaning of the Bulgarian Consumer Protection Act or of the applicable law of the European Union, and that the exclusive jurisdiction under section 16.3 remains fully valid. If you are a consumer, or if you intend to use the Output to place bets, you may not register. Nor may a business established in the United Kingdom (England, Scotland, Wales or Northern Ireland).
3.2 By registering, and on every day you use the Service, you represent and confirm that:
- you are registering on behalf of a business — a company or other legal entity, or yourself as a sole trader or freelancer — and act solely in a professional capacity, as an authorised representative of the legal entity or as an independent software expert or developer for the purposes of your business, not as a consumer, and you are authorised to bind the Subscriber;
- the name of the business, its country, its registration number in a commercial or other public register or its VAT identification number, the contact email and every other detail you provide are accurate, and you will keep them up to date;
- your use of the Service is lawful in the country where you are established and wherever you use it, and you comply with all laws applicable to your business;
- neither you nor any of your owners or directors is subject to sanctions of the European Union, the United Nations, the United Kingdom or the United States, and you do not use the Service in breach of such sanctions.
3.3 Licensed Operators. If you declare at registration that you hold a licence or registration to organise betting, or that you are a platform serving only operators that hold one, you also represent and warrant, on registration and on every day you use the Service, that:
- you hold a valid licence or registration to organise betting in every territory where you use the Output to offer bets and will keep it valid for as long as you do, or you are a platform that provides its system only to operators that hold such licences;
- the licence or registration number you provide is accurate, and you will keep it up to date;
- you bear sole responsibility for offering bets to Your Customers: which markets you offer, at which odds, with which limits and margins, the acceptance and refusal of bets, settlement and payment, the rules for players (including a palpable-error rule), responsible gambling, anti-money-laundering, data protection, advertising and every other requirement of your regulators;
- you do not offer bets to persons in the Republic of Bulgaria without a licence under the Bulgarian Gambling Act, and your websites are not on the list of the Bulgarian National Revenue Agency of sites that organise gambling without a licence; the competitions of Bulgaria are available only as Annex A provides;
- Romania: either (a) you hold a class I licence of the Romanian National Gambling Office (ONJN) for every site and platform for which you use the Output, or (b) those sites and platforms do not allow access or registration from the territory of Romania (blocking by IP address and by country of residence) and do not accept deposits from players in Romania; in both cases they are not on the ONJN list of unlicensed sites;
- Greece: your sites and platforms are not on the blacklist of the Hellenic Gaming Commission, and you do not use the Output for players in Greece unless we have confirmed in writing that the Service may be used there;
- you alone are responsible for any licence that the holders of rights in the competitions (leagues, federations and their data partners) require from betting operators, for example a licence to use so-called official data, and for the source you use to settle bets; we do not receive data directly from such rights holders and are not their licensee.
3.4 What the Free Plan may be used for.
- Every Subscriber may use the Service and the Output to evaluate the Service, to develop and test an integration with it, and for its own analysis of the Output.
- The Free Plan is for the purposes of item 1 only. No Subscriber — a Licensed Operator included — may use the Output of the Free Plan to offer, price, accept or settle bets of Your Customers or of any other person, or let anyone else do so. That use needs a paid plan, offered under separate commercial terms (section 1.4), and, for the operator, its licence.
- No Subscriber may place bets on the basis of the Output, for itself or for anyone else, or use the Service where its use or betting is unlawful for it.
3.5 Proof, notice and false declarations. We may ask you at any time for proof of a declaration in sections 3.2 and 3.3 and may suspend the Key until we receive it. We do not verify your declarations automatically. You must notify us by email within two working days if any declaration ceases to be true — for a Licensed Operator in particular if its licence is revoked, suspended or not renewed, or if a regulator opens an inquiry concerning the Service. A false declaration, or any use not permitted under section 3.4, is a material breach: we may end the Key at once (section 13.3), and you are liable for the loss it causes us.
3.6 Territories that certify suppliers. Where a territory requires a licence, registration or certificate from suppliers of odds or risk services, a Licensed Operator must tell us before using the Output there to offer bets. We hold no gambling licence or certificate. Where your regulator allows you to use an uncertified supplier provided that you assume regulatory responsibility, you assume it. Where it does not, the Service is not available for that territory.
3.7 We do not organise gambling, do not accept or place bets, do not give betting tips or advice, have no dealings with players, and receive no fee linked to the number of your players or to any bet, deposit or loss. We hold no gambling licence and need none for the Service as offered under these Terms.
4. Account and Key
4.1 On registration you receive a Key. It is shown once; we store only a cryptographic hash of it and cannot show it again. If you lose it, we issue a new one.
4.2 Each business may hold one registration and one Key. The Key belongs to the Subscriber and must not be shared; any person holding it acts as you and under your responsibility (section 4.3). A platform that serves betting operators lets an operator use the Output only through that operator's own registration as a Licensed Operator.
4.3 You must keep the Key confidential and transmit it only as described in the Documentation (the X-Api-Key header). You are responsible for every request made with your Key until you notify us that it has been compromised, whereupon we will replace it. Where self-service rotation is available, you may replace the Key yourself; the previous Key keeps working for the overlap stated in the Documentation.
4.4 Where email confirmation is in use, the Key starts working once you open the link in the confirmation email.
5. The Service
5.1 What you get. For the fixtures in the competitions of your Free Plan, the Service provides: the fixtures of the day; our own pre-match probabilities and decimal odds for a catalogue of markets (about 130 per fixture; the number depends on the fixture, because only markets and lines that can carry a margin are published) with an automatic margin; same-game combinations priced as one event; binary contract prices; the settlement of completed fixtures based on the score at the end of regular time; your plan status and usage. The Output is produced by our own models; it contains no odds of any bookmaker or other third party.
5.2 No in-play prices. From the kick-off of a fixture every market of that fixture is returned as suspended. Suspension follows the fixture's status, the elapsed minute or the announced kick-off time, whichever comes first. Markets are also suspended when a fixture is finished, postponed, interrupted, abandoned or cancelled, or when we judge its data incomplete or unreliable. A suspended market carries no usable price. A Licensed Operator must not accept bets on a suspended market and must close betting on a fixture in its own system at kick-off at the latest, without relying on our updates alone (they are sent at intervals, currently every 20 seconds). Any use of a price from the Output after kick-off or on a suspended market is wholly at your risk.
5.3 Your Odds. You may submit Your Odds for a fixture through the documented endpoint. For the time stated in the Documentation (currently 60 minutes from submission) the Output for that fixture is derived from Your Odds instead of ours; after that time, or without a submission, it is derived from ours. We do not check Your Odds; Output derived from them is treated as Output for all purposes of sections 10 to 12, and Your Odds are your confidential information under section 8.2.
5.4 Not included. Bet reporting and the exposure, odds-skew and book-settlement features built on it; outright and season markets; historical prices; the raw data of our sources; the odds of any third party; in-play prices; sports other than football. These are available, if at all, only under a paid plan or a separately signed agreement.
5.5 Changes to the Service. We may change, add to or withdraw features of the Service. Changes that keep compatibility (new fields, markets or endpoints) are made without notice. Changes that break compatibility are published under a new path (for example /api/v2/…), announced at least 90 days in advance by email and signalled by the Deprecation and Sunset headers of the affected endpoints, except where imposed by law, a regulator or a data source; the previous path keeps working until the announced date. Within version 1 of the API the meaning of existing fields does not change. We may remove a competition from Annex A when its data source requires it, with notice where possible.
5.6 Where it runs. The Service runs on servers in the European Union (currently an OVHcloud data centre in Gravelines, France); subscriber data and backups are stored in the European Union. The hosting contract is with OVH Hosting Inc. (Canada), whose group companies outside the United States may maintain the service remotely; the European Commission has recognised Canada as providing adequate protection for recipients subject to PIPEDA.
6. The Free Plan
6.1 Quotas. The Free Plan sets the number of requests a minute, a day and a month, the competitions and the number of fixtures a day that Your Odds may price (Annex B). If you exceed the per-minute limit, the Service returns 429 with Retry-After: 60; if you exceed the daily limit, it returns 429 with Retry-After until 00:00 UTC, when the daily counter resets; if you exceed the monthly limit, it returns 429 with Retry-After until 00:00 UTC on the first day of the next month, when the monthly counter resets. A request for a fixture outside your competitions, and Your Odds for more fixtures in a day than Annex B allows, are refused with 403. Refused requests are not counted. Quotas are hard limits: requests above the quota are refused, and there are no overage charges. Where the Documentation lists endpoints that are served outside the quota (for example your own plan status and the day's list of fixtures), those do not count against it.
6.2 Counting. Every other request served with your Key counts. We record usage per Key and per day; our records form the basis for resolving any dispute.
6.3 Term and extension. The Free Plan lasts 90 days (three months) from registration and ends automatically on the 90th day (section 1.5). Exceptionally, we may extend it on your request, at our discretion, for as long as no paid plan is available for registration; an extension starts a new 90-day term. When the Free Plan expires, the Key stops working. The start and the end of the term, and of every extension, are recorded with the registration.
6.4 Once per business. The Free Plan is available once per company or other legal entity, once per sole trader or freelancer, and once per group of undertakings under common control; one email address, one registration. It may be used only as permitted under section 3.4 and within its limits.
6.5 We may end it at any time. We may change, limit, suspend or end the Free Plan, or any Key, at any time and for any reason, with or without notice. The Free Plan is provided without any obligation on our part and with our liability limited as section 11 provides.
6.6 Fair use. You must use the Service as a business evaluating and integrating an API would ordinarily do: requests driven by your evaluation, integration or analysis. Systematic downloading of the whole catalogue, sharing a Key, automated circumvention of the limits, several registrations for one business, or load that threatens the Service for other subscribers is a breach, and we may throttle, suspend or end the Key.
6.7 Plans announced as coming soon. A plan listed as "coming soon" in Annex B, on the plans page or in any response of the Service is an announcement, not an offer: it is not available for registration, its fee, quotas and date are indicative and may change or never apply, and nothing in these Terms obliges us to make it available. Until a paid plan is available for registration, the Service is offered on the Free Plan only.
7. Licence and restrictions
7.1 For the term of the Free Plan we grant you a non-exclusive, non-transferable, non-sublicensable, revocable right to use the Service and the Output for the purposes that section 3.4 permits to you: evaluation, integration and your own analysis and, for a Licensed Operator, offering bets to Your Customers in its own betting channels in its Licensed Territories and its internal risk management. No other right is granted.
7.2 You may not, and may not allow anyone else to:
- resell, sub-license, rent, lease, distribute, syndicate, publish or otherwise make the Service, a Key or the Output available to any third party, or offer the Output as a standalone data or odds product;
- display or publish the Output anywhere other than to Your Customers in a Licensed Operator's own betting channels or within your own evaluation and analysis — in particular not on odds-comparison, tipping, affiliate, media or social-media sites, and not in advertising;
- use the Output or the Service to build, train, calibrate or improve a pricing, odds or prediction service or model, whether for yourself or for others;
- systematically collect, store or archive the Output into a database beyond what your evaluation and analysis during the Free Plan or, for a Licensed Operator, its regulator's record-keeping rules and disputes with Your Customers require;
- scrape, crawl or harvest the Service, or access it by any means other than the documented API and hub with a valid Key;
- reverse engineer, decompile or otherwise attempt to derive our models, parameters, methods or source code;
- misrepresent the origin of the Output;
- interfere with the Service, probe its security, or exceed, circumvent or share quotas and Keys;
- use the Service in breach of law, of licence conditions or of sanctions, or for a purpose that section 3.4 does not permit to you.
7.3 All rights, title and interest in the Service, the software, the models, the methods, the parameters, the Documentation and the Output, including database rights, remain ours. The restrictions in this section apply whether or not the law protects the Output. You may give us feedback; we may use it freely without obligation to you.
7.4 After the end of the Free Plan you may keep Output received before it only for your own records of the evaluation and, for a Licensed Operator, as far as its regulator's record-keeping rules and disputes with Your Customers require, and for no other purpose; the restrictions of section 7.2 continue to apply to it.
8. Confidentiality
8.1 Confidential information is any information one party discloses to the other in connection with the Free Plan that is marked confidential or should reasonably be regarded as confidential by its nature: your Key, our Documentation, models and parameters, your usage records. Each party uses the other's confidential information only for the Free Plan, does not disclose it to third parties and protects it with at least the same care it applies to its own. Disclosure required by a regulator, court or law, or to advisers bound by confidentiality, is permitted.
8.2 Your Odds. Your Odds are your confidential information. We hold them in memory only for the time they price your fixture (section 5.3), do not store them after that, do not disclose them, and use them for no purpose other than producing your Output; in particular we do not use them to build, train, calibrate or improve our models or to price any other subscriber. The number of your submissions is a usage record under section 6.2.
8.3 Neither party uses the other's name or marks in public materials without written consent. We do not name our subscribers publicly.
9. Personal data
9.1 We process the personal data of your contact persons and, for a sole trader or freelancer, your own (name, email address, the IP address a registration came from, usage records tied to your Key) to run the Free Plan, support you and keep the records the law requires. We are the controller of that data; our privacy notice at https://eskape.pro/privacy says how we process it.
9.2 We do not process data about Your Customers or any other third party, and you must not send us any. The Service needs none: no bet, player, customer or device data passes through the API, and Your Odds contain none. If you send such data in breach of this section, you are the controller of it, you are responsible for it, and we delete it when we find it. Because we process no personal data on your behalf, no data processing agreement is needed.
9.3 You are responsible for the data of Your Customers under your own regulators' rules and for any personal data you process in your own systems in connection with your use of the Service.
10. Disclaimer of warranties — the Output is information, the decisions are yours
10.1 THE SERVICE AND THE OUTPUT ARE PROVIDED "AS IS" AND "AS AVAILABLE", FREE OF CHARGE, WITHOUT WARRANTY OF ANY KIND, EXPRESS, IMPLIED OR STATUTORY. To the fullest extent permitted by law we disclaim all warranties, including any warranty of merchantability, fitness for a particular purpose, title, non-infringement, and any warranty arising from course of dealing or usage of trade. We do not warrant that the Output is accurate, complete, timely, error-free or fit for your purposes, that any market or fixture will be available or priced, or that the Service will be uninterrupted, secure or free of errors or delays.
10.2 The Output is information, not advice. The probabilities and odds are the estimates of a mathematical model (or, under section 5.3, a transformation of Your Odds) and are supplied as information for your evaluation and analysis and, for a Licensed Operator, as an input for its own trading decisions. They are not a recommendation to offer, place or accept any bet at any price, not a guarantee of any margin, hold, turnover or profit, and not financial, wagering or legal advice. Sporting results are random; a well-priced market loses on the day as often as the odds imply.
10.3 You decide, you verify, you are responsible. You alone decide what to do with the Output within the limits of section 3. A Licensed Operator alone decides whether, when and at which odds to offer each market, sets its own prices, margins, limits and acceptance rules, and accepts, refuses, settles and pays bets under its own rules and its regulator's requirements. You check the Output before relying on it, as a prudent operator or developer checks any supplier's data, and you do not use it as the sole input into any decision that matters to you. You verify settlement results against your own source of results before paying out or relying on them. You bear the entire result of whatever you do on the basis of the Output, including the commercial result and the losses of any bets accepted on it, and you alone are responsible towards Your Customers, anyone else affected and any authority.
10.4 Errors. Data is collected, transmitted and computed by machines and may contain errors and delays. Where an Output is a palpable error (for example odds that plainly do not fit the event or the market), you disregard it or, as a Licensed Operator, apply your own palpable-error rules to the bets you accepted; whatever was done with it before a correction is your responsibility. When we learn of an error, we correct it within a reasonable time; correction is your sole remedy for incorrect, incomplete, delayed or missing Output.
10.5 Our public track record, demonstrations, documentation and any statement of model accuracy describe past performance and how the Service works; they are not a promise of future results and not a warranty.
10.6 No service level. We do not promise any level of availability, response time or support. The Service currently runs on one server without redundancy; maintenance is announced where possible. Support is by email at management@eskape.pro, on working days in Bulgaria, as our time allows.
10.7 Nothing in this section limits the mandatory rights the law gives you that cannot be excluded.
11. Limitation of liability
11.1 Maximum aggregate limit of the Provider's liability. The Free Plan is provided entirely free of charge, for the purposes of a limited market evaluation, testing and software integration in accordance with section 3.4. To the fullest extent permitted by the applicable law, the total aggregate liability of the Provider — Evgeni Stefanov Krastev, freelancer, BULSTAT UIC 180745014, VAT number BG180745014 — to the Subscriber and to anyone claiming through it, arising out of or in connection with the Service, the Output or these Terms (whether in contract or in tort, negligence, breach of statutory duty or otherwise), is strictly limited to a maximum total of 100 (one hundred) euro. The Subscriber expressly accepts and confirms that Evgeni Stefanov Krastev provides free access to the software platform and to the proprietary model solely on the basis of this limit and would not enter into this agreement on any other financial terms.
11.2 Excluded loss, in any event. Without limiting section 11.1, and in case any part of it is held unenforceable by a competent court, the Provider is not liable in any circumstances for:
- indirect, incidental, special, consequential, exemplary or punitive loss or damage;
- loss of profit, revenue, turnover, margin, hold, business, contracts, customers, goodwill or reputation, or loss of anticipated savings, even where these are direct loss;
- betting loss of any kind: any stakes, payouts, financial liabilities and losses on bets placed, accepted, settled, voided or paid on the basis of the Output by the Subscriber or by third parties (whether or not in breach of the prohibition of commercial use in section 3.4), including loss caused by wrong, late, missing or suspended prices, wrong settlement results, arbitrage betting or system errors. The parties expressly agree, on the basis of art. 82 of the Bulgarian Obligations and Contracts Act, that losses from gambling and betting activity are not direct and foreseeable loss and are wholly excluded from the Provider's liability for ordinary negligence;
- claims of, liabilities to, refunds to or disputes with the customers, end users, partners or associates of the Subscriber;
- fines, pecuniary sanctions, revocation of licences or other coercive administrative measures imposed on the Subscriber by a gambling regulator (including the Bulgarian National Revenue Agency, the Romanian ONJN and the Hellenic Gaming Commission), a court or a holder of sports rights;
- loss caused by the Subscriber's own systems, prices, margins, limits, rules, staff or integration, by Your Odds, by its failure to verify the Output against an independent source, or by its breach of these Terms;
- loss caused by the interruption, delay, error or change of a third-party data source, hosting or network provider, by an attack on the Service, or by any event in section 15;
- loss of data, or the cost of buying substitute services from third parties.
11.3 Mandatory rules of law. Nothing in these Terms excludes or limits the Provider's liability for loss caused by its intent or gross negligence, for fraud, or on any other ground whose limitation is expressly prohibited by the mandatory rules of Bulgarian law (art. 94 of the Obligations and Contracts Act). The limits do not affect your indemnity in section 12.
11.4 Basis of the agreement. The exclusions and limits in this section 11 apply together, to all claims in aggregate, and whether or not we could have been advised of the possibility of the loss. They form the essential economic and legal basis of this agreement. The Service is offered free of charge only because of these limiting clauses, and the Provider would not provide it on any other terms.
11.5 Any claim against us must be notified to us in writing without undue delay after you become aware of it, and you take reasonable steps to mitigate your loss.
12. Indemnification
12.1 You will defend, indemnify and hold harmless ESKape, its owner, managers, employees and contractors from and against all claims, demands, proceedings, losses, damages, fines, costs and expenses (including reasonable legal fees) arising out of or relating to:
- any bet placed, offered, accepted, settled or paid on the basis of the Output, by you or by anyone you gave access to it, and any claim by or dispute with Your Customers, users or partners;
- any claim, inquiry or sanction by a regulator, authority or court concerning your business or your use of the Output;
- any claim by a holder of rights in a competition or in data (leagues, federations, their data partners) that stems from a licence you must hold yourself under section 3.3(7), or from your display, publication or use of the Output beyond what section 3.4 permits to you;
- your breach of these Terms, in particular of sections 3, 6 and 7, or a false declaration under section 3;
- your breach of law, of licence conditions or of sanctions.
12.2 The indemnity does not cover the part of a claim that is caused by our intent or gross negligence, or a claim that the Output as such, used within what section 3.4 permits, infringes third-party rights for reasons other than a licence you must hold yourself under section 3.3(7).
12.3 We notify you of a claim without undue delay, let you control the defence and settlement (no settlement that imposes an obligation or an admission on us without our consent) and cooperate at your expense.
13. Suspension and termination
13.1 Suspension. We may suspend or restrict the Key, wholly or for a territory, immediately and with or without prior notice: when necessary to protect the Service, other subscribers or data from a security threat or from load that threatens the Service; on the order or request of an authority, a regulator, a court or a data source; when a Licensed Operator's licence is revoked, suspended or not renewed, or it appears on a list of unlicensed operators; when a declaration in section 3.2 or 3.3 is or appears false, or while we verify one (section 3.5); on reasonable suspicion of a use that section 3.4 does not permit or of a breach of sections 3, 6 or 7; or where continuing the Service would expose us to legal liability. We will tell you the reason — in the API's 403 response and by email — before the suspension where possible, otherwise as soon as practicable.
13.2 By you. You may stop using the Service at any time and may ask us by email to close your registration.
13.3 By us. We may end the Free Plan and the Key at any time, for any reason and without notice (section 6.5), and at once if you breach section 3 or 7, a Licensed Operator's licence is revoked for all its territories, you become subject to sanctions, or a data source, a change of law or an act of a regulator makes the Service for your territory impossible or unlawful or subject to a permission we do not hold.
13.4 After the end. The Key stops working and your licence under section 7.1 ends. Sections 3.5, 7.2–7.4, 8, 9, 10, 11, 12, 13.4, 15 and 16 survive. We keep the registration record, the acceptance of the Terms and the usage records for the term of the Free Plan plus five years (the retention the Bulgarian Accountancy Act requires of business records), and the records of registrations never confirmed for 30 days, then delete them.
14. Changes to these Terms
14.1 We may change these Terms. We will publish the new version with its date and version string and notify you at your contact email at least 30 days before it takes effect, except for changes required by law, by a regulator or by a data source, which apply when the law or the requirement does, and for changes that only add features or do not reduce your rights, which apply on publication.
14.2 If you do not accept a change, you must stop using the Service before it takes effect; this is your sole remedy. If you continue to use the Service after the date the new version applies, you accept it. Your registration record keeps the version you accepted.
14.3 Moving to a paid plan, when one is available, is a new agreement under that plan's terms; these Terms end for you on that day.
15. Force majeure and events beyond our control
15.1 Neither party is liable for a failure or delay caused by an event beyond its reasonable control, including natural disaster, war, terrorism, civil unrest, epidemic, strike, act of government or regulator, change of law, failure of public networks, power or hosting providers, or denial-of-service or other attack despite reasonable protection.
15.2 In addition, we are not liable for a failure or delay caused by the interruption, delay, error, withdrawal, change of terms or change of content of any third-party data source we use, including a source of fixtures, results, statistics or lineups, provided we did not cause it. In such a case we suspend the affected markets rather than publish stale prices and use reasonable efforts to recover or replace the source.
16. Governing law and dispute resolution
16.1 These Terms and any dispute or claim arising out of or in connection with them or the Service, contractual or non-contractual, are governed by the law of the Republic of Bulgaria, excluding its conflict-of-laws rules and the United Nations Convention on Contracts for the International Sale of Goods. This is without prejudice to the mandatory rules of a Licensed Operator's Licensed Territories that apply to its business of organising betting.
16.2 Before starting proceedings, the parties will try to settle any dispute through negotiations between their managers within 30 days of a written request.
16.3 Exclusive jurisdiction. All disputes arising out of these Terms or out of the use of the Service that are not settled by voluntary negotiation within the 30 days of section 16.2 are referred exclusively to the competent Bulgarian court in the city of Sofia. The parties expressly confirm that accepting the Terms by ticking an electronic box at registration, together with the record of the version, the time and the IP address, constitutes a valid agreement conferring jurisdiction in writing within the meaning of article 25 of Regulation (EU) No 1215/2012.
16.4 Either party may seek interim or injunctive relief from any competent court to protect its confidential information or intellectual property.
17. General
17.1 Entire agreement. Section 1.4 states the whole agreement. It supersedes any earlier discussion or representation; you have not relied on any statement outside it, including any announcement of a plan as coming soon (section 6.7). The Terms prevail over the Documentation, which prevails over any other material.
17.2 Assignment. You may not assign or transfer the registration or a Key without our written consent, including on a change of control. We may assign the Terms to a successor of our business or to a company we found, and may use subcontractors (hosting, email) while remaining responsible for the Service. When the EOOD founded by ESKape is entered in the Commercial Register, ESKape may transfer its rights and obligations under these Terms in full to that company (section 1.1); by accepting these Terms you consent to that transfer in advance.
17.3 Notices. Notices to you are sent to the contact email of your registration and are deemed received on the working day they are sent (Bulgarian time), or on the next working day if sent after 17:00. Notices to us go to management@eskape.pro. You must keep your contact email up to date.
17.4 Severability; waiver. If a clause is invalid or unenforceable, the rest stays in force and the clause is replaced by the valid clause closest to its purpose. A failure to enforce a clause is not a waiver.
17.5 Independent parties. The parties are independent contractors. Nothing creates a partnership, joint venture, agency or fiduciary relationship. We do not act for you towards Your Customers or any other third party or authority.
17.6 Export and sanctions. You comply with export-control and sanctions laws in your use of the Service.
17.7 Language. These Terms are written in English. The Bulgarian translation is provided for information only. In case of any inconsistency or difference in the interpretation of the clauses, the English text prevails between the parties.
17.8 No third-party rights. Nobody other than the parties has any right under these Terms, except the persons indemnified under section 12.
18. Version
Terms of Use of the Free Plan, version free-2.4-2026-10-23 (the value a registration accepts as termsVersion), in force from 23 October 2026. Previous versions: free-2.3-2026-10-23 (23 October 2026; open to businesses of the United Kingdom), free-2.2-2026-10-23 (23 October 2026; 54 countries and the European club competitions to choose from, betting use for declared licensed operators), free-2.1-2026-10-22 (22 October 2026; one country per registration, Bulgaria only with a Bulgarian licence), free-2.0-2026-10-21 (21 October 2026; business to business, liability limited to 100 euro), free-1.1-2026-10-20 (20 October 2026; licensed betting operators and the platforms serving them only, three fixed competitions, a 30-day term, no liability for free use), free-1.0-2026-10-20 (20 October 2026).
Annex A. Competitions
The Free Plan prices one choice, made at registration from the list shown on the registration page (https://eskape.pro/feed): one of the countries offered there for the Free Plan. A choice covers:
- a country — its top division;
- Bulgaria, Croatia or Serbia — every competition of that country that we price.
The other competitions of a country, its cups included, are not part of its choice, except for Bulgaria, Croatia and Serbia.
The competitions of the paid plans. The competitions of Austria, Belgium, Denmark, England, Finland, France, Germany, Greece, Ireland, Italy, the Netherlands, Norway, Poland, Portugal, Romania, Scotland, Spain, Sweden, Switzerland and Turkey, and the European club competitions (the UEFA Champions League, the UEFA Europa League and the UEFA Conference League), are shown on the registration page as competitions of the paid plans (section 6.7). They cannot be chosen on the Free Plan, and a Key on the Free Plan receives none of their fixtures. We will change your choice at your request by email and may replace or remove a choice, or a competition within it, when its data source requires it (section 5.5).
Bulgaria. The competitions of Bulgaria are available only to a Subscriber that declares, at registration or in a request to change its choice, that it holds a licence to organise gambling issued under the Bulgarian Gambling Act, and gives the licence number. Without that declaration Bulgaria cannot be chosen, and a Key receives no fixture of a Bulgarian competition, whatever its plan. The declaration is a declaration under section 3.3, and we may check it under section 3.5.
